The Hiratsuka summary court ordered a former employee (57) of a cleaning company to pay a fine of 200,000 yen by the 15th.
This man beat a Miniature Dachshund to death with a metal rod during cleaning on September 4 at Kanagawa Animal Welfare center, (Hiratduka). and was prosecuted by Hiratsuka local public prosecutor’s office for violation of the Act on Welfare and Management of Animals.
This man was bitten while trying to move a dog that was immobile due to a hernia.

We were expecting that Hiratsuka local public prosecutor’s office would give a severe punishment because of the maliciousness of the case.
I have mixed feelings about this penalty.

To build a society without the animal abuse, I learned following things from this case.

If your own animal has been abused, please formally accuse and charge for property destruction and violation of Act on Welfare and Management of Animals, don’t just leave charges up to police.

2) If you find animal abuse occurring either to someone’s animal or an ownerless animal, please report to police and file charges for violation of the Act on Welfare and Management of Animals if possible. (You can file charges even though you are not the owner).
Also declare charges to the animal welfare center and the local government office.
In this case, the director of Kanagawa Animal Welfare center filed charges.
It is very effective to have charges filed by the administration.

The man was effectively prosecuted because Kanagawa prefecture made formal accusations.
If the case is disputed, you can make a protest against the result.

Please take these steps and follow through with charges.
You can ask the humane association to do these procedures.

Kanagwa prefecture sent the case to the public prosecutor's office on suspicion of violation of the Act on Welfare and Management of Animals, article 44, alleging the man killed a small dog with an iron bar.

On September 4, 2014, a worker from a cleaning company killed a miniature dachshund at Kanagawa Animal Welfare center.
Inuneko Kyusainowa has demanded prosecution the man under the charge of violation of the Act on Welfare and Management of Animals, (article 44), and the criminal law, article 261, concerning damage of properties.

On October 16, Kanagawa prefecture officially accused the man of violating the Act on Welfare and Management of Animals, (article 44).
Concerning the violation of the property damage law(article 261), the proprietary rights were not clarified, and prosecution for that has been postponed.
Today, the media reported that Kanagawa prefecture sent the case to the public prosecutor's office on suspicion of violation of the Act on Welfare and Management of Animals, article 44.
I am so thankful to Kanagawa prefecture and people who sent opinions on behalf of the victimised dog.
I hope the criminal is severely punished.

To make a society free of animal abuse, it is necessary to give the maximum penalty with every law; not only the Act on Welfare and Management of Animals, but both civil and criminal laws.
For that it is necessary to prosecute officially.

The animal welfare center in each region should accuse officially when animal abuse happens.
Recently, many dog carcasses have been abandoned in some places.
When the identity of the suspect becomes clear, animal welfare centers and the department in charge should file accusations with the police.

Thank you so much for your efforts for animal welfare.

We inform you our decision concerning the fatal accident of a dog in the Kanagawa Animal Protection center.

On September 4, Thursday, an impounded dog in Kanagawa Animal Protection center was assaulted by an employee of the contracted service supplier, which (allegedly) caused it’s death.
We reported it to Hiratsuka police station on September 4.
However, today, we filed charges of violation of the Act on Welfare and Management of Animals, (article 44), against this employee
For the criminal law, article 261, we believe this dog belongs to Kanagawa prefecture.
However, we haven’t arrived at a clear conclusion about that, and at this time we have not filed charges on that count.

Secondly, we try to answer your questions dated October 13, 2014.

Question 1.
In the “volunteer communication” temporary issue for registered volunteers of Kanagawa Animal Protection center, it said that “this accident was caused by an employee who hit the dog and caused it’s death.”
However, charges have not been officially filed, and investigation by police has been insufficient.
It is not even clear who the suspect is.
Has the identity of the suspect been confirmed?
And is the killing method confirmed?


We have now filed charges against an employee, alleging that he used an iron bar to hit and kill a dog protected by the Animal Welfare Center.

Question 2.
Please explain why it has taken so long since this case occurred for police to file charges.
Generally if someone’s property gets damaged, police file charges immediately.

In this case, we reported to Hiratsuka police station on the day of the accident, however it took some time to confirm the relevance of laws and regulations, the suitability and the procedures of charges such as violation of the Act on Welfare and Management of Animals in relation to the jurisdiction of prefectural office and police.


Question 3.
When will Kanagawa prefecture file official charges?
Delays could cause problems in maintaining the evidence and questioning of the suspect.


Concerning the maintenance of the evidence and interview of the employee, since we reported to the police on September 4, the investigation has already started and Kanagawa prefecture is cooperating with this investigation.
Charges were filed today, so we believe the investigation has not been delayed.

On September 4, Thursday, an impounded dog in Kanagawa Animal Protection center suffered an assault by an employee of a contracted service supplier, which allegedly caused it’s death.

Fact of accusation : the accused was contracted by the governor of Kanagawa prefecture, and engaged in cleaning duties for the kennel of Kanagawa Animal Protection Center (401 Tsuchiya, Hiratsuka-shi, Kanagawa). On September 4, between 8:05am and 8:10, this employee hit a dog that was a protected animal (Miniature Dachshund, female, age-indeterminate) with an iron bar, resulting in it’s death, in the operational room of B1.
Purpose of the accusation : It is thought that the act by the accused mentioned above violated the Act on Welfare and Management of Animals, (in article 44). We accuse the suspect, and call for severe punishment.

We, Inuneko Kyusainowa, think that the best way of preventing recurrence of this kind of problem is for the prefecture to file charges against the suspect.

The highest priority is a filing of charges to clarify all aspects of the case.
Details regarding the prevention of recurrence should be considered after the case is concluded.
Again, we ask for immediate charges of violation of the criminal law, article 261, and the Act on Welfare and Management of Animals, article 44.

We, Inuneko Kyusainowa, have some questions, as below:

Will the prefecture prosecute the cleaning company for property damage or not.
If not, why don’t they?
(The dog belongs to the prefecture. This was a flagrant offence and certainly resulted in damage. The Center has the managerial responsibility of protection.)

Will the prefecture accuse the worker and the company of violation of animal protection methods or not.
If not, why don’t they?
(It doesn’t make sense that the Animal Welfare Center, which should educate citizens, doesn’t prosecute this case, which happened on their site.

It’s a publicly facility. In the Code of Criminal Procedure, Article 239, Clause 2, “A government official or local government official shall file an accusation when they believe an offence has been committed.”
What is the reason for not fulfilling this?

They said that they will hold the memorial service on the 25th.
If they accuse the cleaning company, why will they let the accused join in?

TNR Japan Animal Welfare Hospital:
We first opened our TNR Japan Animal Welfare Hospital in February of 2011 in an effort to make our dream a reality - to lower the number of dogs and cats killed in Japan to zero. At our hospital, we spay and neuter cats to reduce the number of unfortunate stray cats. Our hospital strives to help unfortunate animals in need of medical care.
The lives of numerous pets and livestock were lost as a result of the unprecedented earthquake and tsunami that occurred in Japan on March 11th 2011 and the radiation disaster caused by the stricken Fukushima Daiichi Nuclear Power Plant. Animal Rescue Fund goes directly to the 20km evacuation zone around the stricken Fukushima Nuclear Power Plant to rescue animals.
Animal Rescue Fund is based in Kanagawa Prefecture’s TNR Japan Animal Welfare Hospital. Therefore, the animals that we rescue from Fukushima Prefecture are brought to TNR Japan Animal Welfare Hospital located in Kanagawa Prefecture. Here, the rescued animals receive medical care and are returned to their owners or are put up for adoption.
We also work in urging the government and administration of Japan to support the protection of animals in need.
